Privacy & Access Law: The Dangers of Electronic Evidence: Seeing is NOT Believing
In many trials every day, electronic evidence is being distributed, and indeed used, as a proper representation of the actual evidence, even though it is merely a paper printout. This is reckless and unacceptable, but as long as lawyers and judges (and anyone else) do not know any better, it is accepted. Imagine if a murder trial introduced merely a picture of the murder weapon, or merely a picture of the suspect? This presentation will include various types of electronic evidence, and show why you can never trust a paper copy. Social media, text messages, and web pages will be demonstrated. Can you spot the fake ones?
