VAA and TREB have elaborated on various elements that must be considered when evaluating potential liability under s. 79. From plausible competitive interest, to regulated conduct, to the need to justify one’s behaviour vis-à-vis parties who may not compete in the same market, to the intersection of privacy and competition law, businesses and their advisors need to take stock of these rulings. This panel brings together three different perspectives on abuse of dominance. The panelists will discuss and debate how the Bureau, the Bar and economists are likely to approach abuse of dominance cases in the future.
