Hypothetical: A retailer agrees to be an anchor tenant on the condition that the landlord not rent the other units to sellers of competing retail products. Is that a reasonable restraint of trade or an unreasonable barrier to entry? What if the restriction also applies to the landlord’s other nearby properties? What if the landlord is getting above-market rent? Like any good legal question, the answer is, “maybe?” (and it depends on the jurisdiction). Come learn more!
