Constructive Takings: When does a municipality need to pay?
Join Malcolm Lavoie and Adrienne Funk, counsel for the Canadian Constitution Foundation in the recent decision of Annapolis Group Inc. v. Halifax Regional Municipality to discuss the test for constructive taking (de facto expropriation) set out in Annapolis Group Inc. v. Halifax Regional Municipality and relevant case law out of Alberta including Three Sisters Mountain Village Properties Ltd v. Canmore (Town), 2022 ABQB 511.
