The FOIP Fork - Alberta's New ATIA and POPA

Presented by the CBA Alberta Privacy & Access Law (South) Section

Join us for a discussion about Alberta's new public sector privacy legislation: (i) the Access to Information Act; and (ii) the Protection of Privacy Act, which together replace the now repealed Freedom of Information and Protection of Privacy Act. We will discuss:

(i) ATIA's expanded definitions, new powers for public bodies to proactively disclose information, authority to decline repetitive or overly broad requests, revised review and oversight processes, and increased penalties for non-compliance.

(ii) POPA's mandatory breach reporting under a “real risk of significant harm” standard, stronger rules regarding collection, use, disclosure, data matching, de-identification/non-personal data, and automation; requirements for privacy management programs and privacy impact assessments; and penalties for misuse of personal information.
