Family After Death: Estate Responsibilities in Family Law
Presented by the CBA Alberta Wills, Estates & Trusts North Section
We will explore how estate obligations intersect with family law in Alberta, focusing on whether an estate remains liable for debts, support, or property claims after death. Also discuss how separation agreements and statutory frameworks—particularly the Family Law Act, Family Property Act, and Wills & Succession Act—determine when obligations survive, when estates must pay, and how waivers or missing legal advice can affect enforceability.
