
Class Actions and Aboriginal Law: History, Convergence, and Contemporary Impact
Presented by the CBA Alberta Aboriginal Law (North) Section
Our discussion will begin with an overview of the history of class actions and Indigenous empowerment through caselaw. We will then examine the certification and structural requirements of a class action, and discuss the strategic advantages of class actions vs mass torts. Finally, we will look at the broader social and political effects of class proceedings and discuss relevant case studies.
