
The Notwithstanding Clause Goes to Court
Presented by the CBA Alberta Constitutional & Human Rights (North) Section
The upcoming Supreme Court of Canada hearing on the constitutionality of Quebec's Bill 21 will be the first opportunity for the Court to revisit the law of the Charter's notwithstanding clause in nearly four decades. This talk will explore the divergent positions on the clause that have emerged in recent appellate decisions and scholarship, the range of legal arguments on s. 33 that the Court will confront in the hearing, and the paths the Court may pursue in setting out the appropriate approach to the Charter's most controversial provision.
