Alberta Labour, Constitution Notwithstanding: Speculation on ATA and GOA

Presented by the CBA Alberta Labour & Employment Law (South) Section

Semi-Retired Alberta arbitrator Andrew Sims teams up with U of C Law’s Professor Jennifer Koshan to explore the constitutionality of the Alberta government’s usage of the notwithstanding clause to force a new collective agreement and end the strike of the Alberta Teacher’s Association. They will address the impact such use has on the structure of public sector bargaining specifically and Canada’s labour relations system generally. The constitutionality of Alberta's invocation of the notwithstanding clause in Bill 1 will also be discussed in the context of other challenges to the use of s 33 in Alberta and elsewhere.
