For family lawyers in BC, the new Divorce Act will look familiar.  The language and provisions are similar to those of the FLA.  We will explore the similarities - and differences – and discuss a few provisions that will likely need clarification by the courts.  Lastly, we will review:

  • How they might work together - or not;
  • what the one act does the other cannot;
  • how to ameliorate some of those differences; and
  • factors for choosing one over the other, when you have a choice.
