Courts, arbitrators, and human rights tribunals have recently considered the duty to investigate, and the duty of procedural fairness, in investigations in several recent decisions. This presentation will summarize some of those decisions and consider the consequences that could flow from a failure to investigate or from a flawed investigation, as well as practical considerations and approaches for the Investigator.

Leanne M Walsh is an employment lawyer, investigator and mediator at West Coast Workplace Law. She is co-founder and Past Chair of this section.
Pam Costanzo is a lawyer at Young Anderson where she practices exclusively in the areas of labour, employment and human rights. Pam is currently a Member-at-Large of the section.
