Synopsis

Crown and Defence lawyers often have to deal with issues surrounding conflicts of issue.  For Crown, they may come across a file where the accused is someone that they interact with professionally and the question becomes whether a particular Crown office can handle the prosecution.  Defence lawyers also have to consider conflicts of interest on a regular basis.  Has the defence lawyer represented the complainant or a witness on a file?  Can the defence lawyer represent multiple co-accused on a file?  Can the defence lawyer represent a co-accused when he or she has represented the other co-accused previously?  Are defence lawyers sharing office space precluded from representing co-accused? 

Join Basil McCormick, Nanaimo Crown Counsel, and Jenny Rutherford, Senior Counsel at Jones & Company, for an overview of the conflict issues that arise between Crown and Defense Counsel, with discussions of the relevant case authorities to help you navigate this practice area.
