Synopsis

If you're confused about jurisdiction over workplace human rights, things are about to get even more complicated. Amendments to the Workers Compensation Act will soon impose a duty on certain employers to maintain an injured worker’s employment and to accommodate the worker to the point of undue hardship. The mandate to enforce these duties will fall to WorksafeBC and the Workers Compensation Appeal Tribunal.

Alissa Demerse and Kevin Love discuss which workers and employers are covered by these new provisions, what WorksafeBC can do to enforce them, and how these amendments may impact other decision-makers like the labour arbitrators and the Human Rights Tribunal.
