This session covers the Recent changes to the mineral claim registration in British Columbia in response to the recent decision in Gitxaala v British Columbia (Chief Gold Commissioner), 2023 BCSC 1680 (CanLII).  The Gitxaala decision found that the province had a duty to consult First Nations prior to allowing for registration of claims and gave the province until March 26, 2025 to implement a system that enables such consultation.  

On March 26, 2025, the Province has implemented its Mineral Claims Consultation Framework (MCCF).  Debbie Chan, Senior Counsel, Natural Resource, Transportation, and Indigenous Legal Group and Justin Schroff, Director, Responsible Mining & Competitiveness, about the MCCF and how it is designed to help B.C. meet its duty to consult by requiring consultation before any claim registration. Mineral claim registration occurs under the Mineral Tenure Act (MTA).
