Sujit Choudhry, Robyn Trask, and Humera Jabir address the limits of the "notwithstanding" constitutional override enacted by s.33 of the Charter of Rights and Freedoms. Recent litigation in Quebec, Alberta, Saskatchewan and Ontario challenged the scope of the notwithstanding clause and its effect on the constitutional jurisdiction of superior courts. The panel provides an update on past cases and anticipates the arguments to come, with special attention to the question of whether s.28 of the Charter, which guarantees Charter rights equally to men and women, applies notwithstanding the notwithstanding clause.
