Alexander Lonergan and Clare Sparks review the framework of privacy law in British Columbia, including the role of the Office of the Information and Privacy Commissioner, and how privacy concerns might commonly arise in estate matters. They explore an estate representative’s obligations to protect a third party’s privacy in administering an estate or litigating an estate matter, with a particular focus on the new Intimate Images Protection Act, and an estate representative’s duties under the Personal Information Protection Act and Freedom of Information and Protection of Privacy Act.
Speaker Bios
Alexander Lonergan is an adjudicator with the Office of the Information and Privacy Commissioner for British Columbia. Acting with delegated authority from the Commissioner, Alexander issues written decisions arising from complaints and reviews of decisions made under FIPPA and PIPA. Alexander is a practicing lawyer with experience in the fields of privacy, conveyancing, corporate, estate planning and Indigenous law. Alexander and his wife live in Ucluelet, B.C. where they spend most of their weekends at the beach or in the rainforest.
Clare Sparks began her legal career practicing in Vancouver, British Columbia. Originally a family law lawyer, she moved to Victoria in 2018 and broadened her practice to include estate litigation. She now practices exclusively in estate litigation, drawing on her years in the family law bar to better serve blended families, and to help her clients navigate some of their most complex life changes.
