SYNOPSIS
The first part of this section begins with Nancy Cameron QC’s introduction of Forrest (Woody) Mosten. Forrest (Woody) Mosten provides an entertaining overview of the history of unbundled legal services in the United States and Canada and a description of his practice and how he coined the term “unbundling”. He traces the development of rules, training, toolboxes and creative lawyer websites in the US and notes the support of many US malpractice insurers. Woody discusses the growth and future of unbundling and discusses its many benefits to the public and the legal system. Kari Boyle and Nancy Cameron then trace the development of the unbundling movement in BC including Mediate BC’s Family Unbundled Legal Services project, the development of new business and pricing models and the critical next steps to maintain the momentum of the movement.
The second part of this section is a presentation by Laurel Dietz (Alinea Legal Coaching, Victoria BC) who details her thoughtful intake and assessment process as well as her legal coaching model. Her model has three phases: pre-intake; intake session; post-intake session. Not all potential clients are suitable candidates for unbundling and Laurel and Woody discuss how a detailed assessment will assist in making that assessment.
