Blended-family files generate a predictable set of disputes: the family home, beneficiary designations that contradict the Will, joint title presumptions, and “understood” promises to adult children that never made it into the plan. This session provides a practical drafting toolkit designed for British Columbia’s WESA environment, with an emphasis on clause architecture, harmonization across instruments, and defensibility (documentation and governance) rather than theory.

Nicco Bautista discusses a “risk map” of common failure modes, practical drafting checklists for the family home and spousal benefit structures, an “instrument harmony” checklist spanning Wills, trusts, title, and designations, and a single case study that ties the tools together. Recent case law developments and their planning implications will also be highlighted.
