TOPIC: Behind the Breath: Ensuring Accountability and Integrity in Remote Alcohol Monitoring

This CPD session explores the evolving role of remote alcohol monitoring in family law, with a focus on promoting child safety, ensuring accountability, and supporting recovery. Using real world examples and evidence-based practices, we’ll examine how courts and professionals can Leverage technology to reduce conflict and enhance transparency in high-conflict custody cases
involving alcohol use concerns.

• Substance use in custody cases: Prevalence and patterns
• Overview of alcohol testing methods: EtG, urine, transdermal, blood, and remote breathalyzer technology
• Key elements of a court-admissible alcohol monitoring protocol
• Tamper detection, facial recognition, and test integrity safeguards
• Common challenges: Missed tests, manipulation attempts, and coordinated communication
• Drafting effective court orders and parenting plans that incorporate monitoring
• Case studies: High-conflict parenting plans using remote monitoring
• Ethics and privacy considerations in electronic monitoring
