In light of potential depressed valuations of Canadian businesses and opportunistic takeovers, the Canadian government announced early in the pandemic that foreign investment related to public health or critical goods and services, or made by state-owned enterprises, would be subject to enhanced scrutiny. The number and length of national security reviews under the Investment Canada Act has since been on the rise. This panel will provide a practical look at assessing the risk and navigating a national security review in the context of the newly extended time frames.
