What’s “Trending” in Canadian Privacy Law & Privacy Litigation

Privacy law in Canada is an increasingly dynamic and complex area. This two-part session is intended for both new and seasoned privacy lawyers.

The first part of the session will focus on key developments in privacy law, including recent court decisions, regulator guidance and orders, the status of ongoing federal privacy law reform, how to navigate seismic change and uncertainty as Quebec rolls out changes to its privacy laws, changes to BC's data sovereignty laws, and the prospects for Ontario's proposed private-sector privacy legislation.

The second part will provide an update on the recent trends and developments in privacy litigation, including the rapid recognition of novel privacy torts like public disclosure of private facts (e.g., Cope v. Gesualdi in ON & E.S. v. Shillington in AB) and important developments in class actions, like the first privacy class action heard on the merits (e.g., Setoguchi v. Uber B.V. in AB, Owsianik v Equifax in ON, and Lamoureux v OCRCVM in QC).
