The Growing Role of First Nations and Indigenous Communities in Construction Projects

This session will review the involvement of First Nations in Construction Law.  This will include discussions on recent First Nations projects in British Columbia, UNDRIP and DRIPA and the duty to consult in connection with projects and real estate development, issues related to the leasing of reserve lands, both under the Indian Act and the land codes, and the leasing of lands that are governed by a self- government agreement.

Current trends in mid-project dispute resolution

Unlike fine wines, disputes do not get better with age. Mid-project disputes can put successful project completion at risk. Parties to major projects have developed alternative dispute resolution strategies to keep progress on track in the face of a dispute, including mid-project mediation, expert panels, and dispute adjudication boards. These dispute resolution processes certainly provide many advantages over traditional litigation, but they are not without their own challenges and risks.

At this session, you will learn about recent experiences and explore effective means of managing and resolving disputes mid-project. You will hear from practitioners from across Canada, consider trends in mid-project dispute resolution, and learn when and how mid-project dispute resolution can help your clients keep their projects moving.
