Ethical Considerations in Family Law: Codifying Changes in the Model Code and Beyond

In the context of increasing calls for reforms in Family Justice across the country, the new Divorce Act, and greater focus on family violence, the rights of children and youth, and Indigenous peoples in Family Law, the CBA Family Law and Child & Youth Sections, together with the Ethics & Professional Responsibility Subcommittee of the CBA have proposed amendments to the Model Code of Professional Conduct for Family Law Lawyers. The proposed amendments include new commentary clarifying the role of Family Law Lawyers in Non-Adversarial Proceedings and New Ethical Standards for Family Law Lawyers.
