SESSION 3: Ethical Issues for Litigation

Part 1:  When Your Case Goes Viral:  ‘I do not litigate in the media’ made sense when media and the courts operated in distinct spheres and it was possible to segregate your conduct of the litigation from the outside context.  In our brave new wholly-integrated and dominated by lightening-fast communication world, the historic approach may no longer be appropriate to protect litigants or the process.  This discussion will consider counsel’s ethical obligation to their clients, to opposing counsel and opposing parties, and most importantly to the Court when a case goes viral.

Part 2:  The Costs of Hallucinating:  A review of various Canadian Court’s rules and practice directions relating to how counsel and lay litigants may and may not us AI in preparing court materials, and the evolving costs consequences of misusing AI in the court process.
