Free Speech and Professional Regulation
This webinar will explore the current national landscape on the issue of restrictions on free speech in the context of professional regulation. With recent legislation passed (but not yet in effect) in Alberta, which once in force with place restrictions on professional regulators’ authority to restrict or regulate the speech of professionals, this is a topical issue. By contrast, other provinces show trends in the opposite direction, with tribunal and court decisions upholding the regulator’s authority and jurisdiction to regulate speech on current issues including vaccines, COVID-19, and transgender and non-binary rights. This developing dichotomy raises several interesting legal issues, in particular for professions that are subject to federal or provincial labour mobility legislation.
