Make Your Motion Count: Choosing, Building and Pressure-Testing the Right Motion
The developing litigator is often taught how to prepare a motion. The more valuable skill is knowing whether the motion should be brought at all. With clients increasingly focused on cost, proportionality and results, litigators need to distinguish a motion that advances the case from one that simply creates more litigation.
Before recommending the next motion, determine whether it is worth the client’s time, money and strategic capital. Develop the judgment to:
- Define what the motion needs to accomplish within the larger case.
- Weigh the likely benefit against cost, timing, evidentiary readiness and strategic risk.
- Design focused relief and assemble the record needed to support it.
- Pressure-test the motion against the opponent’s strongest response and likely judicial concerns.
- Recommend whether to proceed, modify the approach, wait or not bring the motion at all.
