Summary disposition should not first become a strategic question once discovery is over. By then, opportunities may already have been lost. The more valuable skill is recognizing a potential path to earlier determination while the record is still being built, then making deliberate choices that preserve or strengthen that opportunity.

• Reassess the opportunity as the case develops and decide when to pursue summary disposition, narrow the issues or change course.
