When Litigators Face Sanctions: Preventing Missteps and Responding When Something Goes Wrong
The risk landscape for litigators is changing. Lawyers remain responsible for what they put before a court even when information or work has come from a client, colleague, expert, online source or AI-assisted process. A verification failure, inaccurate representation or litigation misstep can create consequences not only for the client, but personally for counsel.
Protect your credibility before a preventable error becomes a professional problem. Build the judgment and safeguards to:
- Recognize conduct and errors that can expose counsel to sanctions, personal cost consequences or other professional repercussions.
- Verify authorities, factual assertions, quotations and evidence before relying on them.
- Establish appropriate review controls for delegated, technology-assisted and AI-assisted work.
- Detect warning signs that warrant further investigation, supervision or escalation.
- Respond appropriately when inaccurate or unreliable material has already been filed, served or relied upon.
