A small number of babies, but significant in absolute terms, suffer brain injury during labour and delivery each year. Damages in these cases are very significant. This session will cover the challenges to proving how and when in utero injury occurs. Obstacles imposed by ‘authoritative’ literature and methods to uncover the ‘truth’ will be discussed. Ways to mitigate the risks of pursuing these highly complex and important cases will be reviewed.
