Capacity or Lack of Capacity

SYNOPSIS
Capacity and decision-making are fundamental concepts in both Enduring Powers of Attorney and Supported Decision-making. Capacity to sign documents, when to activate and use them, capacity to make a specific financial, property, or personal care decision all involve understanding and assessing a person’s capacity. How should lawyers do it? How do health care professionals do it? How can an authorized Attorney assess a grantor’s capacity to make a decision?
Whether for persons with a diagnosed disability needing assistance or support, persons dealing with diminishing or inconsistent ability to make decisions, or mental health issues, advising clients and their Attorneys, Assistants and Supporters about capacity and decision-making is important.
This presentation will review the risks and opportunities for professionals working with vulnerable people by learning from issues and solutions developed by members of the multidisciplinary team at the Capacity Clinic.
The learning objectives of the session will be:
• To understand what decision-making capacity is and strategies to identify the risk factors.
• To be aware of the commonly applicable statutory framework applicable to capacity assessments and evaluations.
• To be aware of resources to access in order to service vulnerable clients in order to reduce barriers and liability.

There will be a 20% administration charge on any cancellations received in writing by the CBA Branch office up to three (3) business days before the program. No refunds after that, although materials and recording, if any, will be forwarded. Registration substitution is permitted. ABC-NB-CBA reserves the right to cancel sessions due to low registration.
