Youth in care experience unique challenges when they face charges in the criminal justice system particularly with respect to attaining judicial interim release, and issues around sentencing and recidivism. Child protection legislation and agencies are tasked with the supervision and care of youth. However, does the implementation of such legislation unintentionally and disproportionately marginalize youth in care? What approach should youth advocates and justice system participants engage to address this disparity? Our stellar faculty will examine if we are addressing these issues while applying the Youth Criminal Justice Act and its unique principles.

Does the year-old Child, Youth and Family Services Act improve the approach of the courts as it relates to “cross over youth”? How has the Supreme Court of Canada’s decision in R. v.
