2020 has truly been a memorable year. This includes in the area of employment law where a number of decisions have been released by the Supreme Court of Canada and Ontario Courts that will have a lasting impact on employment litigation and employment agreements. At this program we will review the following decisions:

  1. The Supreme Court of Canada, in Matthews v. Ocean Nutrition Canada Ltd., clarified how additional compensation should be taken into account during a constructive dismissal or a termination without cause;
  2. The Supreme Court of Canada, in Uber Technologies Inc. v. Heller, provided guidance on enforceability of arbitration clauses in service contracts;
  3. The Ontario Court of Appeal, in Waksdale v. Swegon North America Inc., provided guidance on severability of termination clauses and employment contracts generally; and
  4. The Ontario Superior Court of Justice, in Kerner v. Information Builders (Canada) Inc., clarified when an employee is entitled to commission payments after termination.
