OBA Public Sector Lawyers PROGRAM | Original Program Date: June 25, 2020

As recovery begins, issues have arisen around enforcement of regulations and the ability to proceed with inspections, investigations and audits while maintaining physical distancing limitations. Current regulatory requirements and enforcement procedures do not have the built in flexibility that is now required during a global health crisis. Can investigations and inspections move from in person to virtual? Is evidence collected through online investigations permitted? Going forward, will more legal requirements be put in regulations instead of legislation to make them more adaptable to unforeseen events, and how will that impact government accountability considering that regulations don’t require as much transparency as legislation? These are some of the issues that will be addressed as our speakers guide you through the immediate challenges with regulatory enforcement and help you prepare for the future of regulation post pandemic.
