On July 30th, the Ontario Government filed O.Reg. 431/20: Administering Oath or Declaration Remotely, made under recent amendments to the Commissioners for Taking Affidavits Act. The regulation came into force on August 1, 2020. This Regulation sets out the circumstances around which a Commissioner of Affidavits can remotely commission a document in Ontario. For any lawyer commissioning affidavits in Ontario, this is a significant change. This expert faculty will take you though what is in the Regulation and how to commission a document remotely while avoiding potential traps. Specifically, they will discuss:

  • What basic technology requirements you need to commission a document remotely.
  • How to undertake identification verification.
  • What you need to retain for your records.
  • Best practices to guard against fraud, identity theft and undue influence.
