New Duties of Legal Advisors under Family Law Legislation [WEBCAST ONLY]

Apr. 29, 2021

OBA Alternative Dispute Resolution and Family Law Sections, FDRIO and OACP PROGRAM
9:00 AM to 11:00 AM (ET)

Effective March 1, 2021, lawyers are now required under section 7.7(2) of the Divorce Act and section 33.2(2) of the Children’s Law Reform Act to advise clients about the range of family dispute resolution processes available and encourage clients to attempt to resolve matters through these processes outside of Court, unless it would clearly not be appropriate to do so. Lawyers must also certify that they have fulfilled these duties.

Ensure you have the knowledge you need to comply with your new obligations with this essential program. Our expert faculty will unravel the various family dispute resolution processes available as we explore:

  • How to talk to clients about process options to ensure your obligations are met
  • Advantages, disadvantages and myths about each process
  • How to select the right process and best professional for your client
  • When is it “clearly not appropriate” to encourage an out-of-court process?
  • Screening and process customization where domestic violence concerns have been raised
