Mass tort litigation is on the rise in Canada. This model involves a series of individual claims arising out of the same or similar acts and is often seen where harm is allegedly caused by medical devices, prescription drugs, or defective consumer products. The trend towards mass tort litigation presents both opportunities and challenges for counsel.
While mass tort litigation has long been an alternative to class actions in the United States, it is a newer phenomenon in Canada, and courts have offered only limited guidance on how it might function in practice. Ontario lacks a dedicated procedural framework governing mass tort litigation, forcing practitioners to strategically fashion new (and sometimes creative) ways of advancing their positions.
This program will analyze the tools available to counsel litigating claims brought under this model, and provide first-hand, practical insights from lawyers at the forefront of mass tort litigation in Canada.
