Drawing on years of courtroom advocacy and dispute experience, Kim will address the distinct considerations that arise when mediation is pursued by parties who are already engaged in litigation, compared with mediations initiated as an out-of-court option from the outset.

- Key differences in approach: tactical, procedural and ethical distinctions between mediating a live litigation file and mediating pre-litigation disputes.
- Client counselling and expectations: how to advise clients who are mid-litigation about timing, risks, settlement value, and strategic trade-offs.
- Practical tips & real-world examples: lessons from Kim’s practice on moving matters out of court toward negotiated resolution while protecting clients’ litigation positions.
