Environmental & Resources Law: Life in Plastic, the FCA Finds Ain’t Fantastic
This presentation will cover the recent case of Attorney General of Canada v. Responsible Plastic Use Coalition, 2026 FCA 17, where the Federal Court of Appeal upheld the listing of plastic manufactured items (PMI) under CEPA. The presentation will cover the distinction between listing and regulation in CEPA’s two-stage scheme, the precautionary principle, and the limits of judicial intervention in scientific decision-making. It will also briefly cover and address the constitutional arguments surrounding the federal criminal law power.
