Since the Supreme Court of Canada’s seminal decision in Redwater, environmental liabilities in insolvency proceedings have continuously been held sacrosanct by the Courts, winning a variety of different priority contests. Our panelists, Ms. Robyn Gurofsky and Ms. Kelsey Meyer have been involved in several of these priority disputes, including the recent decisions rendered in the Manitok and Trident receivership proceedings. Please join the CBA Insolvency South Section meeting for a discussion of priority disputes in the wake of Redwater and where the bounds of the so-called “super-priority” for environmental liabilities in insolvency may lie.
