Synopsis

Please join the Appellate Advocacy Section for an important discussion on professionalism and ethics in appellate practice with the Honourable Mr. Justice Frankel of the Court of Appeal, the Honourable Martin Taylor, Q.C., and Margaret Mereigh.

This section meeting will seek to engage with a number of challenging ethical and professionalism issues facing counsel on appeal. Our panelists offer perspectives from current and former justices of appeal and senior counsel.

Some of the general topics for discussion will likely include:

  • Ethical challenges in taking on certain types of appeals;
  • Professionalism leading up to the hearing of the appeal and the unwritten professionalism rules of appellate practice;
  • Challenges in dealing with opposing counsel and self-represented litigants;
  • Making submissions to the court on appeal, including challenges with the factual record and dealing with unhelpful authorities; and
  • Other ethical and professionalism issues arising on appeal.

This section meeting is designed for all counsel of all levels.

If there are questions or topics you would like to see addressed, please submit them in advance to tposyniak@fasken.com.
