Synopsis

Keith Sabey of Sabey Rule LLP will review a number of cases, which stand for the long-standing proposition that a creditor’s interest in real property can be no greater than that held by the debtor, and how that proposition was unexpectedly and problematically challenged in the two recent cases of Gully v Gully, 2018 BCSC 1590, and MCAP Service Corporation v Chichak, 2018 BCSC 1892. Keith successfully distinguished these two recent decisions in Mazzei et. al v. Preferred Credit Resources, March 28, 2019 BCSC (unreported). Keith will also briefly address the issue of special costs in the context of allegations of fraud, and behavior akin to fraud.

The View Room will open at 5:30pm and dinner will be served at 6:00pm.
