The Evolving Definition of a Spouse

At our next meeting, Amy Mortimore, senior estate lawyer and partner at Clark Wilson LLP, will give us an update on the definition of a "spouse" in the estate context. Amy will discuss some of the most recent cases on this topic, including  

  • Re Connor Estate, 2017 BCSC 978;
  • Re Berkenbos Estate, 2018 BCSC 1661; and
  • Mother 1 v. Solus Trust Company, 2019 BCSC 200.

Ultimately, Amy's presentation will focus on the questions of whether the courts are broadening the definition of "spouse" and how we may contribute to the development of the definition going forward. 

Gillian Crouch, associate in the wills and estates practice group at Singleton Reynolds LLP, will present a case comment on Salomon v Matte-Thompson, 2019 SCC 14, a recent professional liability case where a lawyer encouraged his client to invest in what turned out to be a Ponzi scheme.

Sections host webinars from Internet-capable venues where significant interest has been expressed by Section members in attending remotely. This Section meeting will be offered as a teleconference or webinar depending on the resources and technology available at the venue.
