Synopsis
The recent controversy involving WE Charity calls attention to certain corporate structuring strategies employed in Canada’s charity and non-profit sector. It is a common practice for hospitals, schools, and social service or arts organizations to engage in corporate structuring in which an operating charity runs in parallel with a separately registered charitable foundation. However, if such corporate structuring is not carefully considered, certain legal risks may arise. During this CBABC Charity and Not-for-Profit Law Section meeting, Margaret Mason will overview both the advantages and pitfalls to pursuing a multi-entity structure, along with suggested best practices before deciding to advise a client to embark on this kind of corporate structuring.
