ONLINE MEETING: Privacy and Public Health: Can the Two be Balanced During a Pandemic?
This meeting is being hosted by the Freedom of Information & Privacy Law and Health Law Sections.

Synopsis
The panelists will discuss the privacy and FOI matters in the context of the COVID-19 pandemic, including: the relaxing of the “in Canada only” data hosting requirements for public bodies, the extension of time to respond to FOI requests, contact tracing, and conducting temperature checks for employees and customers. The panelists will also address the right to privacy while in a public space.  Lastly, the Section will provide an update on its written submissions to the Legislative Assembly’s Special Committee to review the Personal Information Protection Act, including the need for health-specific privacy legislation in British Columbia.
 
Speaker Bios

Daniel Reid is an associate at Harper Grey who practices in the areas of health, defamation, privacy and media law.  In his defamation and privacy practice, Daniel frequently appears in proceedings relating to online anonymity, sealing orders, injunctions restraining publication and digital production orders.  He is cited by the Supreme Court of Canada (in conjunction with Mr. Baynham, QC) in the leading case concerning liability attached to “hyperlinks”.  Daniel is a sought after speaker on legal/technological issues, including Facebook and Twitter, and has appeared on local and national news programs, including CTV National News, CBC National News, and CKNW radio.   In his health law practice, Daniel represent clients in civil and privacy matters and has appeared at all levels of court in British Columbia and at the Supreme Court of Canada.  Daniel is also a past chair of the CBABC Health Law section.

 

Suzanne Kennedy is a partner at Harris & Company LLP who has built a strong practice in access and privacy law. She advises both public and private sector employers on their responsibilities as they navigate the implications of FIPPA, PIPA, PIPEDEA, and other related legislation. Suzanne regularly provides one-on-one training to in-house privacy and access coordinators on responding to access requests, conducting internal investigations, and the use of internal system information.  In addition to privacy law, Suzanne has extensive experience in education and health law. Suzanne has represented various healthcare and educational professionals and organizations, providing advice in a range of areas including employment, professional regulatory proceedings and compliance, court and administrative tribunal proceedings, procurement, and contract negotiations.

 

Alexis Kerr is counsel at Norton Rose Fulbright Canada LLP who uses her recent 12 years of experience (seven as general counsel) advising British Columbia's largest health authority, as well as her previous private practice experience as a commercial litigation and privacy lawyer, to provide practical, business-driven and results-oriented advice and assistance to clients in the healthcare industry and in all industries where privacy and data protection is an ongoing and ever-evolving challenge.  In the healthcare space, she advises health authority boards and senior executive teams on all aspects of law that affect their broad-based operations, including conducting administrative hearings. She is well versed in leading complex contract negotiations, formal and alternative dispute resolution, managing clinician behavioral and clinical practice issues, and facilitating enterprise risk management.  On the data protection and privacy front, Ms. Kerr has many years of experience advising organizational clients on compliance with applicable privacy laws, data mapping and developing privacy impact assessments, developing privacy management programs, policies and procedures, employee training and education, investigating and managing data breach incidents and litigating privacy-related issues before both privacy regulators and the courts.
