ONLINE MEETING: A "New Wave" of Protest Injunctions: Enjoining the Coastal Gas Link Blockades

Synopsis

The three month period from December 2019 through February 2020 saw an explosion of applications brought by government and other entities seeking to restrain protests and blockades with respect to re Coastal Gas Link project. Counsel from the Department of Justice Canada and the Attorney General of British Columbia with first hand experience with these recent injunctions will provide an overview of developments in injunction law, culminating in this "new wave" of protest injunction orders.  There will also be a discussion of practical tips and considerations for public sector lawyers applying to enjoin a protest or blockade.

Speaker Bios

KYLE FRIESEN is the legal advisor to the RCMP Deputy Commissioner for British Columbia (“E” Division) and all RCMP personnel in B.C. Since 1998, he has provided "live" legal advice on all operational and administrative policing matters. He was Legal Counsel to the Vancouver 2010 Integrated Security Unit for the 2010 Winter Olympics.  Mr. Friesen has appeared in all levels of Courts in British Columbia and the Yukon Court of Appeal, as well as national and provincial administrative tribunals.  One of his specialties is public order policing in national infrastructure developments, including pipelines and related public protests and injunctions.  He was called to the B.C. Bar in 1985.

MICAH WEINTRAUB is a lawyer with the Civil Litigation Group, Legal Services Branch, BC Ministry of Attorney General and chair of the CBABC, Public Sector Lawyers’ section. Micah co-leads an injunction working group and was counsel for the Province in the Maple Ridge tent city litigation and application to enjoin a protest blockade of the Patricia Bay highway earlier this year.
