RISK MANAGEMENT: COMMON ERRORS MADE BY ESTATE LAWYERS AND HOW TO AVOID THEM

Synopsis

The Lawyers Insurance Fund (LIF) manages the Law Society’s insurance program for BC lawyers. The majority of their work involves handling negligence claims and potential negligence claims. With their unique position as the single insurer for all lawyers in the province, LIF has detailed information relating to every matter reported since 1986. As a result of that data, as well as LIF’s ongoing monitoring and analysis of specific risks, the lawyers at LIF may be regarded as specialists on risk management.

Megan Swail is one of the 10 lawyers at LIF who act as Claims Counsel. Her job is to investigate and manage claims, in relation to the 1,000 or so reports that LIF receives each year. At our next meeting, Megan will educate us about some of the most common errors she’s seen and inform us how to protect ourselves from the risk of a negligence claim, particularly in the areas of estate planning, estate administration, and estate litigation. 

Ken Kramer, QC, will present a case comment on S. A. v. Metro Vancouver Housing Corporation, which is the most recent Supreme Court of Canada decision on discretionary (disability) trusts.

BONUS: This meeting provides 1.0 CPD credits in ethics and practice management.
