An update on the anticipated direction of environmental law by the US federal government following the 2020 US presidential election.

Delivered by the Chair of the American Bar Association’s Section of Environment, Energy and Resources: Howard Kenison, Jones & Keller, P.C.

2:00 pm – 3:30 pm Recent Developments in Federal Enforcement and Related Litigation

Case studies focussing on evidentiary, procedural and sentencing/valuation issues in recent federal environmental enforcement matters and a related civil class action:

  • Prairie Mines & Royalty’s guilty plea and sentencing to a $3.5 million fine and a rehabilitation order for two charges under the Fisheries Act relating to a tailings release into the Athabasca River will be discussed by the federal prosecutor and a Department of Justice counsel
  • Volkswagen AG’s guilty plea and sentencing to a $196.5 million fine for 60 charges under Canadian Environmental Protection Act, 1999 (for importing vehicles which contravened prescribed emissions standards) and related issues will be discussed by the federal prosecutor
  • Related Dieselgate consumer class action against Volkswagen (settled for over $2.5 billion) will be discussed by class action counsel
