Global climate destabilization has profound implications across markets & industries. Among other things, it affects supply chains, market opportunities, capital costs, inflation, and asset valuations. And that is over and above its impact on Earth’s life-sustaining eco-systems. Climate change is the challenge of the 21st century. For business, climate risk management needs to be the central focus for their strategy & operations. However, before they act, they need data.

Against that backdrop, comes the International Sustainability Standards Board (“ISSB”). The ISSB has been tasked by the Financial Stability Board with taking the recommendations from a group called the Task Force on Climate Related Financial Disclosures (“TCFD”) and turning them into concrete standards around which businesses can report. Using this data, decision-makers can assess climate risks and opportunities, develop sustainable business strategies, and make informed decisions. The ISSB’s work will impact regulators, investors, asset managers, executives, entrepreneurs, accountants, and, of course, lawyers.

So, how do you measure climate risk in business terms? What does the ISSB do? What are the recommendations from the Task Force on Climate Related Financial Disclosures? How will this change financial reporting? Will this change how businesses govern? How will this impact corporate law, banking law, securities, and other core areas? Will it fall to lawyers to advise clients on climate-related risks?

These are the questions we will engage at the CBA’s Climate Disclosure Symposium.

SESSION 1: Level Setting: Climate Risk & TCFD Basics

What are climate-related risks and opportunities? How can we categorize them? What does "discontinuity" mean for 21st century regulation, risk management, and legal practice? This session will offer viewers essential context and conceptual frameworks with which to engage deeply & confidently with the sessions that follow.

Session 2: Updates in A Rapidly Changing Space

In 2023, the ISSB took over responsibility for integrating the TCFD recommendations into the IFRS® sustainability disclosure standards. The work is ongoing, and work is progressing quickly. This session will focus on the latest news, what’s expected in 2024, and why it should matter to Canadians.

As Canadian regulators draft new mandatory standards, businesses are likely to struggle to adapt to these new rules. What can businesses do now to prepare? Join our panel who will engage these questions.

But, even without the new standards, existing duties in Canada (and elsewhere) unambiguously require fiduciaries to turn their minds to climate-related risks and opportunities. What happens if they do not? What liability exposure should Canadian businesses expect if they do not manage climate effectively? Join our panel who will engage these questions.
