Giving Clear Advice When the Law Is Not Clear
This scenario is where many lawyers get stuck.
When the law is uncertain, the instinct is to protect against being wrong. The impulse may be to qualify every statement, list multiple possibilities without prioritizing them, and avoid a clear position.
The result is advice that is technically careful, but difficult to act on, because it does not clearly indicate what matters or what should be done. This can apply equally to in-house lawyers advising business teams, where decisions still need to be made and unclear or overly cautious advice can slow progress or shift risk in unintended ways.
Enhance your capability to focus on how to be clear without being reckless by knowing how to:
- Provide a real answer, even when the law is not settled
- Express risk in a way that supports decisions and does not avoid them
- Move from “it depends” to “here is what I recommend”
- Balance caution with clarity so your advice can truly be used
