A recent study has shown that approximately 95% of cases that do not settle at mediation do settle at some later time rather than go to trial. This distinguished panel will explore both the strategic and psychological reasons as to why this occurs. In other words, why are litigants deferring making difficult settlement decisions at the mediation? What can we, as mediators and advocates, do to improve the likelihood that the matter will settle at the mediation?
